Johnson & Condon Lawyers Present on New "Best Value" Construction Contracting Law
Shamus O'Meara and Mark Azman recently presented to several public owner groups on the new Best Value contracting law. The law provides an alternative to the current "lowest bid" law for municipalities through the use of pre-selected criteria for evaluating bidders. The law is phased in over the next three years and will be available to all municipalities by 2010. There are a number of questions surrounding the new law, including whether any training will be made available, the highly technical aspects of creating bid selection criteria and evaluating bidders using this method, and how bid protests will be handled.
